These Terms & Conditions lay out the agreement for using this website.
This website is run by ethereal. The terms “we”, “us”, and “our” in these Terms & Conditions refer to ethereal.
By using this website and/or making a purchase from us, you agree to abide by the terms outlined in these Terms & Conditions. Your continued use implies your understanding and acceptance of these conditions. If you do not agree to these conditions or lack the legal capacity to agree to them, you should stop using the website.

The information provided and products sold on this website are not intended to treat or prevent any medical condition or do any other special function. ethereal does not promise that its products will provide any specific results. We do not accept legal liability for how are products are used once sold. Any links to other websites are for informational purposes only, and ethereal is not responsible for the content of those websites.
Intellectual Property
ethereal retains ownership of all its intellectual property, including product designs, names, descriptions, and images. You agree not to copy or otherwise make unauthorised use of ethereal’s intellectual property.
Guarantees
ethereal provides this website and its products “as is” and “as available”. We do not guarantee the availability, reliability, accuracy, or security of this website and any products offered for sale.
There may be errors, omissions, or other inaccuracies in prices, availability, shipping charges, and product descriptions. ethereal reserves the right to correct any such errors/omissions/inaccuracies, including after you have submitted an order. When this affects the price, we will offer you the option to cancel your order if you do not wish to pay the corrected price.
Nothing in these terms is intended to have the effect of contracting out of the provisions of the Consumer Guarantees Act except to the extent permitted by the Act.
Except as otherwise required or prevented by laws including the Consumer Guarantees Act, or except as expressly provided under these terms, ethereal is not liable for any claim in relation to any products we supply to you.
Indemnification
To the extent allowable under the law, you agree to indemnify and hold ethereal along with its owners, employees, and agents harmless from and against any and all claims, liabilities, damages, losses, or expenses arising out of or in any way connected with your use of this website and our products.
Acceptance of orders
By placing a product order through this website, you are deemed to accept the terms and conditions of sale. You are bound to pay us the price once we accept your order. ethereal reserves the right to decline an order for any reason. Orders placed to be shipped outside of New Zealand may be declined for countries where we deem shipping not to be practical.
Product condition
You accept that ethereal’s products* are created through a hand-made process and are sold “as is”. The “as is” condition of the product will not be sufficient grounds for ethereal to grant a refund or return.
*With the exception of LED lights and USB wall chargers.
Price
All prices (unless specified) exclude freight, and are subject to change without notice.
Purchase prices are given in New Zealand dollars unless otherwise stated.
The listed purchase price is for the product only. Shipping costs along with any taxes and duties will be added to the final price.
Payment
You must pay in full for the goods purchased before we will deliver the goods to you. Ownership remains with ethereal until full payment has been received.
Delivery
Where we agree to transport the goods to a specified place, we will arrange delivery of the goods to that place. Except where otherwise agreed, you will pay for all resulting transportation costs.
Returns and refunds
Without limiting any rights you have under the Consumer Guarantees Act, all goods to be returned must have a Return Authority issued by us. The issue of a Return Authority does not guarantee that we will accept the return.
Changing your mind/purchasing the wrong product by mistake: ethereal will not accept these as sufficient grounds to grant a return or refund.
Incorrectly supplied products: If you have been accidentally supplied the wrong product, ethereal will supply the correct product (where it is available) or issue a refund.
-You need to notify us within 7 days of delivery;
-You will first need to return the wrong product to us before we will supply the correct product;
-The wrong product supplied must be in resalable condition.
Products damaged in transit:
If your product has been damaged during transit to your delivery address, ethereal will meet our obligations under the Consumer Guarantees Act. Otherwise, you will need to make a claim with the company that transported the goods. Please check the product upon delivery, and if there is damage, contact us within 24 hours of delivery.
Products that are faulty upon arrival: We will meet our obligations under the Consumer Guarantees Act. In order for us to remedy the situation, you need to contact us to request this within a reasonable time as defined under the Act. Shipping costs for returning goods will be at your expense except where such charges are our responsibility under the Consumer Guarantees Act.
Risk and ownership
Risk of any loss, damage or deterioration of or to the products passes to you on delivery.
Governing law
This contract and its terms are governed by, and shall be construed in accordance with, the laws of New Zealand. Both parties submit to the exclusive jurisdiction of the courts of New Zealand.
